Terms and Conditions

Welcome to the Residence Incentives Stay Experience (RISE) Rewards Program (“the Rewards Program”). These Terms and Conditions (“Terms”) govern your participation in the Program and describe how you can earn and redeem points (“Points”). By enrolling in the Program or redeeming Points, you agree to be bound by these Terms.

JOIN THE REWARDS PROGRAM

  1. Eligibility
    1. Membership in the Rewards Program is free and available to any individual who: (a) possesses the legal authority to agree to the Program Rules; (b) resides in a jurisdiction which legally permits participation in the Rewards Program; (c) provides valid and accurate personal information when enrolling in the Rewards Program; (d) is not already a member of the Rewards Program (i.e. does not already have a Rewards Program membership account (“Membership Account”)); and (e) has not previously been terminated from the Rewards Program.
    2. Corporate entities, travel agents, and groups are not eligible for membership.
    3. Members are responsible for reading and understanding the Program Rules, Account statements, and other communications from Residence On Langley Park (“ROLP”) about the Rewards Program in order to understand his/her rights, responsibilities, and status in the Rewards Program. If a Member has any questions about the Rewards Program or these Program Rules, the Member should contact rolp_info@the-residence.com

     

  2. Enrolment
    1. Completing the Enrolment Application. An individual may apply to enrol in the Rewards Program by fully and accurately completing an application on https://loyalty.the-residence.com/sign-up or enrol at the reservations desk. ROLP may deny membership in the Rewards Program to any applicant in its sole discretion and without written notice. 
    2. Individual Membership. Only individuals are eligible for the Rewards Program membership, and each individual may maintain only one Membership Account. All Rewards Program Accounts are individual accounts, and no joint or shared accounts are permitted even if the individual resides within the same household. Rewards Program benefits are non-transferable unless expressly stated otherwise. Upon enrolment, members will receive a unique membership number. Members are responsible for ensuring their account information is accurate and up to date.

     

  3. Membership Types
    1. The minimum age for individual Members to enrol in the membership program is 21 years old. ROLP has the right to change, limit, modify or cancel the Rewards Program rules and awards, with or without notice, even though such changes may affect the value of points. The membership tiers under the Rewards Program are as follows:-

    2. The Rewards and Benefits applicable to each membership tier are subject to availability and may be varied, suspended, or withdrawn by ROLP at any time in its sole discretion.
    3. Tier status is awarded based on a member’s qualifying activity within a 12-month period (“Membership Year”). Once a new tier level is achieved, a member’s tier status will remain valid for 12 months from the date of upgrade, unless otherwise stated by ROLP.
    4. To retain a tier level for the following Membership Year, members must meet or exceed the published qualifying criteria before the end of their current Membership Year. If the qualifying criteria are met before expiry, the tier status will automatically renew for another 12-month period from the renewal date. Members may view their qualification progress at any time through their online account.
    5. Members who meet the qualifying criteria for a higher tier within their current Membership Year will be automatically upgraded. The upgraded tier becomes effective immediately upon qualification and remains valid for 12 months from the date of upgrade. Any additional qualifying activity beyond the required threshold during the same Membership Year will not carry over to the next period.
    6. If a member does not meet the qualifying criteria for their current tier by the end of the Membership Year, their status will be downgraded to the tier that corresponds to their actual qualifying activity. Downgrades will take effect at the start of the new Membership Year.

     

  4. Points Accrual
    1. Subject to the other Terms and Conditions set out below:-
      1. Members earn Points for eligible stays booked directly through ROLP’s channels (website or reservations desk). 
      2. Every member enrolled in the Rewards Program will receive a sign on bonus of 100 points. 
      3. A Rewards Member will earn one (1) Rewards Point for every AUD $1 spent on eligible room reservations that are charged and reflected on the final guest checkout statement. Points will not be awarded on taxes, fees, or third-party bookings. To earn points, the Member’s active Membership ID (Email ID) must be provided at the time of reservation or at check-in, and the Member must be one of the registered staying guests.
      4. Rewards Points shall be awarded for no more than two (2) room reservations per stay that are registered under and charged to the Member’s RISE Rewards account. To qualify, the Member must be a registered occupant for at least one (1) of the rooms.
      5. To ensure points are posted to the correct Member Account, the membership ID included at the time of booking or provided at check-in must be correct. 
      6. Points accrued are non-transferable, whether by operation of law or otherwise, either to any other person or entity or Member Account.
      7. Points accrued in the Member Account cannot be converted into cash value or voucher.
      8. ROLP may run promotions from time to time that provide additional points and/or enhanced benefits to select members. 
      9. Points will be credited to the member’s account within 2-3 business days after check-out. 
      10. No Points will be earned on stays booked through online travel agencies (e.g. Booking.com, Expedia) or for complimentary, promotional, or discounted industry rates. 

     

  5. Points Expiration and Account Inactivity
    1. Points will expire twelve (12) months from the date they are earned unless the Member earns or redeems Points within that period. ROLP reserves the right to amend the Points expiry policy at any time. 
    2. Members must remain active in the Rewards Program to retain points they accumulate.
    3. A Member Account that records no earning or redemption activity for a continuous period of eighteen (18) months shall be deemed inactive. Upon a Member Account being deemed inactive, all Points then remaining in the Member Account shall be forfeited, and the Member Account may be deactivated at ROLP’s sole discretion.
    4. Members can remain active in the Rewards Program and retain accumulated points by earning points. 
    5. Once points are forfeited, the points cannot be reinstated, but a member can earn new points, unless that Member’s Account has been deactivated. 
    6. A Member may cancel his/her membership in the Rewards Program at any time by sending a written notice of cancellation to rolp_info@the-residence.com. All unredeemed points and awards as well as achieved member status will be forfeited immediately and may not be reinstated or transferred.
    7. Cancellation or Suspension by ROLP. ROLP may cancel a member’s accumulated points, suspend Rewards program benefits, suspending membership status (which will subsequently also remove protection against the forfeiture of points should the member become inactive), or cancel a member’s Account at any time with immediate effect and without written notice, for any reason and in ROLP’s sole discretion including, without limitation if ROLP believes the member has:
      1. Acted in a manner inconsistent with applicable laws, regulations, ordinances; 
      2. Failed to pay any of ROLP’s bills when due;  
      3. Acted in an inappropriate, fraudulent, abusive or hostile manner; 
      4. Breached or violated any of these Program Rules; 
      5. Engaged in any misconduct or wrongdoing in connection with the Rewards Program, including, without limitation with respect to Points, the usage of the points, or any other Rewards Program Member benefits. 
    8. Subject to applicable law, a member’s membership in the Rewards Program will terminate automatically upon the member filing for bankruptcy or otherwise being subject to a bankruptcy proceeding. 
    9. Legal Action. Nothing contained in this Program rules will limit ROLP in the exercise of any legal or equitable rights or remedies. 

     

  6. Points Redemption 
    1. Members may redeem Points through the Members Dashboard by selecting the “Redeem” button to notify the ROLP Reservations/Concierge team of their request for free stays, room upgrades, or any other rewards listed on the loyalty website https://loyalty.the-residence.com.
    2. The ROLP Reservations/Concierge team will contact and email the Member within 2-3 working days after the Member initiates the “Redeem” request.
    3. A minimum of 2,500 Points is required for redemption.
    4. Points may be redeemed provided the Member’s account is in good standing at the time of the redemption request.
    5. Points accrued in the Membership Account can only be redeemed by the Member’s themselves and are not transferable. 
    6. By redeeming rewards, the Member releases ROLP, its subsidiaries and affiliates from any and all liability regarding the redemption or use of any rewards, or other participation in the Rewards Program.
    7. Redeemed rewards are not exchangeable for other rewards, or refundable, replaceable, or transferable for cash or credit under any circumstances or sold. 
    8. Once accrued Points in a Membership Account have been redeemed for any rewards in the Rewards Program, such Points cannot be refunded or transferred back into the Membership Account.
    9. If you register, participate or enrol in various programmes, offers and/or events, ROLP may in certain circumstances deduct Points from your Membership Account  (e.g. as a reservation / cancellation fee) in accordance with such applicable terms and conditions.
    10. ROLP reserves the right to cancel, change or substitute the rewards or the rewards conditions at any time with or without notice.
    11. Redemptions believed to have been bartered, sold, exchanged, or issued fraudulently, or issued to someone other than the eligible Member, will be void and will not be honoured. 
    12. Members will not receive points for the award redemption stay portion of their stay. 
    13. Reservations using Points are subject to blackout dates and availability and bedding, smoking, and other room preferences may be requested, but are not guaranteed. 

     

  7. Additional Terms of Participation in the Rewards Program
    1. ROLP reserves the right to monitor the accounts of all members, at any time and without notice. ROLP may review all Members’ points, qualifying stays, and qualifying nights balances and transaction history including, without limitation, requests for Rewards program awards, and other benefits. 
    2. At any time and in ROLP’s sole discretion (including, without limitation, where a Member was not eligible to earn a specific benefit pursuant to the rules herein), ROLP may correct (i) the number of points; and (ii) any other benefit that has been credited to a member’s account. ROLP also reserves the right, in its sole discretion, to prevent, cancel or reconcile any transaction where the Rewards Program suspects there has been fraudulent activity connected with the transaction. 
    3. Points, awards and other member benefits may be subject to income or other taxes. The Member is responsible for paying all such taxes and for making all applicable disclosures to third parties including, without limitation, the party who paid for the transaction from which the member earned points. ROLP will not be liable for any tax liability, duty or other charges in connection with the issuance of points, awards and other member benefits.
    4. ROLP makes no warranties or representations, either expressed or implied, with respect to type, quality or fitness of goods or services provided through the Rewards program.
    5. ROLP is not responsible for (a) any loss or misdirection or, or delay in receiving, any member application, correspondence, redemption requests, awards or member benefits; (b) theft or unauthorised redemption of points or awards or use of an award; (c) any acts or omissions of third parties; or (d) any errors published in relation to the Rewards program, including, without limitation any pricing or typographical errors, errors of description, and errors in the crediting or debiting of points from member accounts. ROLP reserves the right to correct, without notice, any errors.
    6. All interpretations of these Rewards program rules regarding membership are at ROLP’s sole discretion, and ROLP’s decisions will be final. In the event of any discrepancy between the English version and any translated version of these program rules, the English language version will govern.
    7. ROLP are the sole and exclusive owners or licensees of the trademarks, service marks, trade names, logos and copyright or copyrightable materials of ROLP. Members shall never, directly or indirectly, interfere with, challenge, file applications for, or claim ownership of these trademarks anywhere in the world.
    8. ROLP’s waiver of any breach of these Rewards Program rules by any member will not constitute a waiver of any other prior or subsequent breach of these program rules. ROLP’s failure to insist upon strict compliance with these Rewards program rules by any member will not be deemed a waiver of any rights or remedies ROLP may have against that or any other member. ROLP may waive compliance with these program rules in its sole discretion and may run promotions from time to time that provide enhanced benefits to select members.
    9. In no event will ROLP, its subsidiaries and affiliates, and each of their respective directors, officers, employees and agents be liable for any direct, indirect, special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with the Rewards program, these program rules or ROLP’s operation of the Rewards program.
    10.  Any disputes arising out of or related to the Rewards program or these program rules will be handled individually without any class action, and will be governed by, construed and enforced in accordance with the laws of Western Australia. 
    11.  Membership in the Rewards program and the earning and redeeming of points are subject to all applicable local laws and regulations. Membership in the Rewards program, member benefits and awards are offered in good faith, however they may not be available if prohibited or restricted by application law or regulation. If any part of these Rewards program rules is held to be unlawful or unenforceable, that part will be deemed deleted from these program rules and the remaining provisions shall remain in force. 
    12.  The Rewards program rules, together with any other terms and conditions, rules, or regulations incorporated herein or referred to herein constitute the entire agreement between ROLP and the members relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available via email to ROLP’s Guest Services. 

     

  8. Modifications, Suspension and Termination
    1. ROLP reserves the right to modify, suspend or terminate the Rewards Program, these Terms, or the rewards structure at any time, with or without notice, in accordance with Australian Consumer Law (ACL). 
    2. If the Rewards Program is terminated, Members will have 90 days from the date of notice to redeem remaining Points. 
    3. ROLP will not be liable for any loss of value or benefits arising from such changes or termination, except to the extent required by law. 

     

  9. Privacy and Data Protection
    1.  ROLP collects and uses personal information in accordance with its Privacy Policy available at https://rolp.the-residence.com/australian-privacy-policy/
    2.  By joining the Program, Members consent to receiving marketing communications related to the Program. Members may opt out at any time in accordance with applicable laws, including the Spam Act 2003 (Cth). 
    3.  Members are responsible for reading ROLP’s privacy statement in order to understand how ROLP collects, uses, and discloses a member’s data. 
    4.  If a Member has any questions about the privacy statement or its collection, use, or disclosure of a Member’s data, the Member should contact rolp_info@the-residence.com

     

  10. Limitation of Liability
    1. Nothing in these Terms excludes, restricts, or modifies any rights or remedies a Member may have under the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
    2. To the fullest extent permitted by law, ROLP and its affiliates are not liable for any indirect, incidental, or consequential loss, including any loss of Points, arising from participation in the Rewards Program.
    3. Members are responsible for the security of their account information and for any activity under their account.
    4. ROLP makes no warranties regarding the continued availability of the Rewards Program or specific rewards.

     

  11. Governing Law
    1. These Terms are governed by and construed in accordance with the laws of Western Australia.
    2. Members irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
